Trike Rental Terms of Use

These terms set out the conditions of the trike (Can-Am Ryker) rental service provided by IBUKI BASE Inc. (“we”) at “JP resort.” Please apply only after agreeing to these terms (the applicant, the “User”).
Article 1 (Application)
These terms apply to all contracts for the rental of trikes between us and the User. Matters not stipulated herein are governed by law or general custom.
Article 2 (Eligibility)
We cannot rent to any person who: - Does not hold a valid ordinary driver’s license (automatic-only licenses accepted) - Is under license suspension or revocation - May be unable to drive normally due to alcohol or other reasons - Has seriously breached a previous contract with us - Is a member of organized crime or other anti-social forces
Article 3 (Reservation and formation of contract)
Reservations shall be made through our designated reservation site or other methods we approve. The rental contract is formed upon delivery of the vehicle on the rental day, after verification of the original driver’s license and agreement to these terms.
Article 4 (Cancellation fees)
The following fees apply to cancellations for the User’s convenience: - Up to 3 days before the rental date: free - 2 days before: 40% of the fee - The day before: 80% - On the day / cancellation without notice: 100% No cancellation fee applies if we cancel the rental due to bad weather or other reasons at our discretion.
Article 5 (Pre-rental check)
At handover, we check the condition of the vehicle (scratches, equipment, etc.) together with the User and explain how to operate it. If you feel unsure about riding, please ask for practice before departure.
Article 6 (Rules of use)
The User shall observe the following: - Comply with the Road Traffic Act and other laws - Never drive under the influence of alcohol - Up to 2 riders per vehicle (an additional fee applies for a second rider) - Do not sublease or lend the vehicle to third parties - Do not ride off public roads (beaches, rough terrain, etc.) - Do not modify or disassemble the vehicle - Helmets are not legally required, but we recommend wearing one for safety (we do not provide rentals)
Article 7 (Hours and return)
Business hours are 9:00–18:00. Return the vehicle to our base by the designated time with a full tank of fuel. An excess charge applies if the return time is exceeded. Please consult us in advance for rental or return outside business hours.
Article 8 (Coverage and accidents)
We offer a coverage plan (details and conditions are explained at handover). In the event of an accident, the User shall immediately take necessary measures such as aiding the injured and preventing danger on the road, and contact the police and us. Accidents not reported to the police are not covered. In addition to repair costs and deductibles, we may charge actual costs such as compensation for the period the vehicle is out of service.
Article 9 (Breakdown and theft)
If a breakdown or abnormality occurs during use, stop driving immediately and contact us. Actual costs will be charged for theft due to insufficient care by the User, or for loss of or damage to keys.
Article 10 (Prohibited acts and termination)
If the User breaches these terms or is found ineligible under Article 2, we may immediately terminate the contract and demand the return of the vehicle. In this case, fees already received will not be refunded.
Article 11 (User’s liability)
Fines for parking or traffic violations during use shall be borne by the User. If the User causes damage to us or a third party by intent or negligence, the User shall compensate for such damage.
Article 12 (Personal information)
We handle the User’s personal information appropriately in accordance with our Privacy Policy.
Article 13 (Disclaimer)
We are not liable for damage arising from natural disasters, severe weather, or other causes not attributable to us.
Article 14 (Governing law and jurisdiction)
These terms are governed by the laws of Japan. Any dispute shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location.
Article 15 (Amendments)
These terms may be amended as necessary. The amended terms take effect when posted on this page.
